For many intended parents, understanding the surrogacy process in the United States can feel overwhelming at first.

There are multiple steps, different professionals involved, and important decisions along the way. While every journey is unique, having a clear overview of the process can make it easier to move forward with confidence.

Based on years of experience supporting intended parents, the U.S. surrogacy process generally follows several key stages.

 Step 1: Initial Consultation and Planning

The journey typically begins with an initial consultation. 
At this stage, intended parents:

• discuss goals and preferences
• understand the overall process
• review timelines and expectations
• begin financial and logistical planning

Step 2: Choosing an IVF Clinic

Selecting the right IVF clinic is an important early decision in the surrogacy process.
The IVF clinic and physician play a central role in the medical aspects of the journey.
They typically:

• perform egg retrieval (if using an egg donor or intended mother)
• conduct medical screening for both the egg donor and surrogate
• develop and manage the treatment protocol
• perform the embryo transfer
• monitor the early stages of pregnancy

After the pregnancy is established and stable, care is usually transitioned to the surrogate’s OB provider for ongoing prenatal care.

Step 3: Egg or Sperm Donor (If Needed)

If intended parents require an egg donor or sperm donor, this step involves both selection and coordination.
Typically, the process includes:

• reviewing donor profiles based on preferences
• coordinating medical screening through the IVF clinic
• aligning timing between donor availability and treatment plans

Many agencies do not maintain their own donor database and may refer intended parents to external egg donor agencies.

Step 4: Matching with a Surrogate

The embryo transfer is then performed according to this schedule, followed by pregnancy testing and early monitoring.

Step 8: Pregnancy and Ongoing Coordination

If the embryo transfer is successful, the journey continues through pregnancy.
Medical care transitions from the IVF clinic to the surrogate’s OB provider, while communication continues between the surrogate and intended parents.

        2018年10月30日， 特朗普总统表示，他计划发布一项行政命令：“如果新生儿的父母不是美国公民， 则暂停美国出生的婴儿获取公民身份”。

         那么问题来了，他真的可以这样做吗？
        他可以尝试，但是他的这一行为将会因为违宪而被视作无效。

        国会，而非总统有权制定法律。总统能做的是制定行政命令，来指示联邦机构通过某种特定的方式执行命令。行政命令只在现任总统在任期间有效，下一届总统可以推翻该行政命令（就像特朗普推翻了奥巴马在位时颁布的很多行政命令一样）。
        但是如果特朗普真的颁布了该项行政命令，你可以预期到的是：在接下来的几天之内，美国的很多州或者是组织将会起诉美国政府以阻止该命令生效。当行政命令被起诉和反抗时，法院很可能暂停这项行政命令直至法院作出最终判决。上述情形已经发生在特朗普所提出的某些行政命令中，而且其中一些命令已经被宣布为无效了。
        一旦这个案件被提交到法院，法院将会判断特朗普是否有权根据美国宪法暂停在美国出生的孩子自动获得美国公民身份的权利。根据宪法的明确规定，他是不能够这样做的。美国内战结束之后，1868年通过的宪法第十四次修正案规定：“在美国管辖范围内，在美国出生或入籍的所有人均为美国公民，且属于他们居住地所在州的人民”。
        特朗普无权颁布一项与该修正案直接相悖的行政命令。此外，法院将会根据先前的判例对宪法进行解释，这就意味着他们将会与最高法院过去的判例保持一致。最高法院已于1898年对United States v. Wong Kim Ark一案作出裁决，且在1988年的Miller v. Albright一案中再次确认了前案的判决: 即第十四次修正案确立和保障在美国出生的人自动获得公民权利。因此，即使国会通过了一项法律——拒绝给予在美国出生的外国父母的婴儿公民身份——法院之前已经认定该法律违宪。所以，人们可以对法律进行合理期待：在宪法被修改之前，在美国出生的孩子仍将自动成为美国公民；且宪法的修改是非常困难和缓慢的，在过去的230年内只修改过27次，且最近的25年内从未修改过。

除了以上这些做代孕妈妈的基本要求和条件外，寻求代孕的父母们也有自己的一系列“愿望清单”，比如说， 最好住在自己居住的州，离得近一些， 或者想要特定的种族或信仰，再或者想要一个素食者或遵循某种特定饮食习惯的人， 或者想要一个不工作的家庭主妇，或者小孩子不要太小。另外，还需要考虑费用的问题，代孕妈妈是否有保险， 她的补偿费用是不是在自己的经济条件范围内。如果费用不是问题的话，那么代孕妈妈是不是有过成功的代孕经验，还有，如果想要双胞胎的话，代孕妈妈是不是愿意怀双胞胎，代孕妈妈的长相的是不是符合眼缘，等等等等，这个“愿望清单”可以无限延长。
 
在美国，代孕是一个双向选择的过程，除了寻求代孕的父母们的“愿望清单”外，我们再来看看代孕妈妈这边的。代孕妈妈对于为什么样的夫妇或家庭代孕也有自己的想法，她可能希望对方是同性恋，也可能希望只是异性恋；可能只愿意为美国本地的夫妇做代孕，也可能接受外国人；如果她不是单身， 她还需要自己的另一半也能喜欢需要代孕的夫妇；她也可能想要一个在小孩子出生后也能够偶尔保持联系的家庭；她还可能对她做代孕妈妈的费用补偿有不同的要求，等等等等。看，这个清单也是可以无限增加的。
